These Terms of Use ("Terms") govern your use of the Motivation Quotes - Night Owl application ("App") provided by Chroma Capital Inc. ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple Watch device that you own or control, subject to these Terms and the Apple App Store Terms of Service. This license does not allow you to distribute, modify, reverse-engineer, or create derivative works based on the App.
The App is available as a one-time purchase through the Apple App Store. All payments are processed by Apple. We do not collect any payment information directly. Refund requests are handled by Apple in accordance with their refund policies.
You agree to use the App only for its intended purpose: receiving and viewing motivational quotes on your Apple Watch. You agree not to use the App for any unlawful purpose, attempt to gain unauthorized access to the App or its systems, or interfere with or disrupt the integrity or performance of the App.
All content, design, graphics, and code within the App are owned by Chroma Capital Inc. and are protected by intellectual property laws. The motivational quotes provided within the App may include publicly attributed quotes. No claim of ownership is made over the original authorship of such quotes.
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. The motivational quotes provided are for general informational and inspirational purposes only and do not constitute professional advice of any kind.
To the fullest extent permitted by applicable law, Chroma Capital Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App. Our total liability shall not exceed the amount you paid for the App.
We reserve the right to modify these Terms at any time. Updated Terms will be posted within the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
